Single (Individual) User License

A single user license allows one individual the right to use the software. The software may be used only on the computers that the single user regularly uses provided that it is not placed on a server or otherwise made available to unauthorized users. A single user license is restricted to the original registered licensee’s use, even if it was purchased by a company or organization.

By using PK Solutions, you and your company indicate your acceptance of the following license agreement:

1. COPYRIGHT. The software program entitled PK Solutions, hereafter referred to as the "SOFTWARE", is owned by David S. Farrier of Summit Research Services (Licensor) and is protected by United States copyright laws and international treaty provisions. The SOFTWARE is copyrighted © 1997-2004 by David S. Farrier with ALL RIGHTS RESERVED WORLDWIDE.

2. GRANT OF LICENSE. In consideration of payment of the single user license fee for the SOFTWARE, the Licensor hereby grants to the individual Licensee the right to use the SOFTWARE on one computer at a time. The individual Licensee is the person who’s name is registered as the single and sole user. A single user Licensee refers only to a single individual. Groups of more than one person or other individuals within a Company are not included in the Single User License and cannot legally use this SOFTWARE. The single user may not store and use this software from a server which can provide access to the software to non-licensed users. If you want to use the SOFTWARE on a server or network or share it with other computers or other users at your place of work or anywhere else, you must contact the Licensor to obtain a Multiple User or Site/Network License Agreement. Title to the SOFTWARE remains in all cases with the Licensor at all times.

3. OTHER RESTRICTIONS. The licensee agrees not to rent, sublease, lease, loan, convey or distribute for sale the SOFTWARE or any derivative works obtained from the SOFTWARE. The licensee agrees not to modify the SOFTWARE or accompanying user guide. The User Guide is likewise protected and copyrighted © 1997 by David S. Farrier with ALL RIGHTS RESERVED WORLDWIDE. No copies may be made or distributed in part or in whole to anyone without the written permission of the David S. Farrier or his designee.

4. NO WARRANTIES. The Licensor provides the SOFTWARE "as is" and does not warrant that the SOFTWARE will meet customer requirements or be free of errors. The Licensor furthermore expressly disclaims any and all warranties, either expressed or implied, including but not limited to the merchantability, accuracy or fitness for use of the SOFTWARE and accompanying written materials. The Licensor does not warranty a refund policy for purchased or used SOFTWARE. The Licensor’s entire liability, and the licensee’s exclusive remedy, shall be to replace the SOFTWARE and accompanying manual within the period of one year from the date of payment for the license.

5. NO LIABILITY. In no event shall David S. Farrier or Summit Research Services or its representatives be liable for any damages whatsoever (including, without limitation, consequential, incidental, special, punitive, exemplary, or damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of use of or inability to use this SOFTWARE, even if the Licensor has been advised of the possibility of such damages, and whether or not such damages were disclosed to, or reasonably foreseen.

6. The SOFTWARE is designed for research and educational purposes only, and is not intended for use for the diagnosis or treatment of patients.

Three User License

A Three User License basically allows up to three specified individuals within a particular organizational group to use the software. If more than three individuals wish to use the software, then a Limited Site -Network license must be purchased. An authorized user who leaves the group is no longer licensed to use the software, however the license can be transferred to another individual remaining within the group.

By using PK Solutions, you and your company indicate your acceptance of the following license agreement:

An individual Licensee is a person who’s name is registered with the Licensor. The use of the SOFTWARE is restricted to one immediate organizational group or department at the Licensee’s premise or principal place of business. Only one, two, or three individual Licensees within this organizational group may use the SOFTWARE. A Licensee’s right to use the SOFTWARE is transferable only to another individual within the organizational group and only if the original Licensee leaves the group or company for whom the SOFTWARE was purchased. A Licensee’s right to use the SOFTWARE ceases when he or she leaves the group or company for whom the SOFTWARE was purchased. A Licensee may use the SOFTWARE on a principal computer at work as well as on a personal or portable computer. Title to the SOFTWARE remains in all cases with the Licensor at all times.

Limited Site or Network License

A Limited Site/Network license allows the purchasing organization to make the software available to any user within the jurisdiction and on the premises of the limited site (see definition below). The software may not be removed from the premises for continued private use by any individual. It is the responsibility of the purchasing organization to advise users of the priveledges and restrictions of this agreement. Student users are specifically prohibited from copying the software for private use outside of the network or academic site.

By using PK Solutions, the organization that purchased this License and the principal and responsible users, hereafter referred to individually and collectively as the Licensee, indicate your acceptance of the following license agreement:

The Licensee will restrict the use of the SOFTWARE to one immediate organizational group or department at the Licensee’s premise or principal place of business. Only one such organizational group or department at only one site or specific location within the company, business, school, institute or other organization type is licensed to use the SOFTWARE. Within the domain of the Licensee’s specific site, the SOFTWARE can be deployed and used on any computers under the control of the specific organizational unit. Deployment of the SOFTWARE may be on individual computers, via a server, or over a network. If the SOFTWARE is accessed via servers or networks, the Licensee agrees to limit such access only to the licensed site and restrict use of the SOFTWARE by other groups, departments, or other organizational units within the organization which do not have similar license agreements. Title to the SOFTWARE remains in all cases with the Licensor at all times.

3. OTHER RESTRICTIONS. The Licensee agrees not to rent, sublease, lease, loan, convey or distribute for sale the SOFTWARE or any derivative works obtained from the SOFTWARE. The Licensee agrees not to modify the SOFTWARE or accompanying User Guide for reuse or resale. The User Guide is likewise protected and copyrighted © 1997 by David S. Farrier with ALL RIGHTS RESERVED WORLDWIDE. No copies may be made or distributed in part or in whole to anyone outside of the Licensee’s organizational unit without written permission from the Licensor.

4. NO WARRANTIES. The Licensor provides the SOFTWARE "as is" and does not warrant that the SOFTWARE will meet customer requirements or be free of errors. The Licensor furthermore expressly disclaims any and all warranties, either expressed or implied, including but not limited to the merchantability, accuracy or fitness for use of the SOFTWARE and accompanying written materials.
